Book excerpt: Excerpt from Reports of Cases Argued and Determined in the Supreme Court of Ohio, Vol. 3 This volume is properly divided into three parts, according to the date of the decisions, and the changes in the constitution of the court. The first part embraces certain cases, which were not included in the first division of the last volume, for reasons given in the preface to the volume referred to. In the second part, are cases omitted in the second division of the last volume, for the same reasons. In the third part, are the cases furnished to the Reporter, of the decisions made at so much of the last term, as, according to the directions of the court, was to be represented in this collection, As to the third part, James H. Smith was the Reporter, during the session of the court; having been appointed at the beginning of the term, when his predecessor was appointed to fill the unexpired term of Hon. J. A. Corwin. On the expiration of the last-named appointment, Mr. Smith resigned, and Robert B. Warden was again appointed Reporter. In view of these facts, it has been thought proper to use the names of Warden & Smith as Reporters of this volume. The division referred to has not been noticed in the paging.
